DMCA Policy

MiseCentral LLC ("MiseCentral") responds to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512. This DMCA Policy describes how to submit infringement notices and counter-notifications and how MiseCentral processes them for the Website and, where applicable, content stored or displayed through the Services.

1. Designated Agent

1.1. MiseCentral's designated agent to receive DMCA notices is:

1.2. Notices should be sent to the email address above with "DMCA Notice" in the subject line. MiseCentral may update the designated agent information by posting revised contact details on this page.

2. DMCA Takedown Notice Requirements

2.1. To be effective under the DMCA, a takedown notice must be a written communication that includes substantially the following:

(a) identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list; (b) identification of the material claimed to be infringing and information reasonably sufficient to permit MiseCentral to locate the material, such as the URL, account identifier, file name, or other specific location within the Website or Services; (c) your contact information, including name, mailing address, telephone number, and email address; (d) a statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; (e) a statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; and (f) your physical or electronic signature.

2.2. MiseCentral may reject incomplete notices or request additional information before taking action.

3. MiseCentral Response

3.1. Upon receipt of a valid DMCA notice, MiseCentral may remove or disable access to the allegedly infringing material and may notify the user or Customer who posted or controls the material.

3.2. For content stored in the Services, MiseCentral may forward the notice to the applicable Customer administrator where appropriate. Customers are responsible for user-generated and Customer-uploaded content under their Agreement.

3.3. MiseCentral may terminate access of repeat infringers in appropriate circumstances.

4. Counter-Notification

4.1. If you believe material was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to the Copyright Agent containing substantially the following:

(a) identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled; (b) your name, mailing address, telephone number, and email address; (c) a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification; (d) a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, to any judicial district in which MiseCentral may be found, and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person; and (e) your physical or electronic signature.

4.2. If a valid counter-notification is received, MiseCentral may forward it to the original complainant. Unless the complainant files an action seeking a court order against the user within the period specified by the DMCA, MiseCentral may restore the material in its discretion.

5. Misrepresentations

5.1. Any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys' fees, under the DMCA.

6. Service Provider Status

6.1. MiseCentral operates the Website and hosts Customer Data in the Services. With respect to user-provided or Customer-uploaded content, MiseCentral acts as a service provider under the DMCA and limits its liability in accordance with applicable law when it complies with the DMCA's notice-and-takedown procedures.

6.2. Nothing in this DMCA Policy limits MiseCentral's rights under the Terms of Service, Agreement, or other applicable law.

7. Alternative Dispute Resolution

7.1. Rights holders and users remain free to resolve disputes directly. This DMCA Policy does not preclude negotiation, licensing, or other lawful remedies.
